The new Law regulating the protection of persons who report regulatory infringements and the fight against corruption, which will enter into force 20 days after its publication in the Official State Gazette, establishes that private companies with more than 50 employees will be legally obliged to have whistle-blowing channels, and also public administrations, including those entities owned or subject to the control of public administrations. In addition, in the event of having the obligation to have a whistleblower channel, the obligation to have a Data Protection Delegate is also established.
The maximum term to have a whistleblower channel that complies with the aforementioned Law is three months from its entry into force, although, in the case of private sector legal entities with less than 249 employees, the term to have such channel is extended until December 1, 2023.
