The new Law regulating the protection of persons who report regulatory infringements and the fight against corruption, which will come into force 20 days after its publication in the Official State Gazette, states that private companies with more than 50 employees will be legally obliged to have whistle-blowing channels, and also public administrations, including those entities owned or subject to the control of public administrations. Furthermore, in the event of being obliged to have a complaints channel, the obligation to have a Data Protection Officer is also established.

The maximum period for having a complaints channel that complies with the aforementioned Law is three months from its entry into force, although, in the case of legal entities in the private sector with fewer than 249 employees, the period for having such a channel is extended until 1 December 2023.
